iPod touch My new iPod Touch 5 gen changing volume by itself, any suggestions?

so i just got my first touch today, sexy little thing.

but the music volume turns itself to max by itself.
i turn it down, listen to music and BÆMH its on max.
i have no controll that can change volume on my headphones, and it lies beside me, so i am not pushing the volume button by mistake.

any help is appreciated.

Make good use of your free 90 day tech support and call Apple. It sounds like a defective unit that they will replace once they have walked you through all the possible solutions. Give them a call.

Do you have a case on your device? If so, that could be applying pressure to the volume controls.

Some iPhones and iPods had that problem... its a hardware problem... go to apple to change it for a new one.
