Hi all,
You probably can see I just created an account to post this problem because I really need some advice.
I am a long time reader but first time poster, and a die-hard apple fan since high school.

Here is the problem:
When the iCloud photo library just came out, I sign up and upload all my photo on the icloud.
After a month or so, I deleted the whole library since I don't see any point to have all of them all the time.
This is at least 3 months ago (I think).....
Recently, I realized some of the photo I thought are deleted from icloud can still be found and download when I login to iCloud.com. I cannot delete them from neither iCloud nor my Photo app on el capitan nor iOS.
I contacted Apple...
The first 2nd tier support promise will follow up but he never did.
I went to apple store for genius appointment, they told me they cannot do anything.
I called apple again and this time the 2nd tier support did call back, but she said this is a back-end issue and she put a request.....a week pass by, nothing changed. I call the same 2nd tier support person but she told me she has no idea when this will be done, could be hours, days or weeks.

The idea of photo upload to iCloud might get stuck to a point even Apple cannot delete is quite disconcerting. Those photo are just family photo (so safe for work) but still I would like to remove them from iCloud. The whole key selling point of Apple ecosystem is they are one of the tech company that respect people's privacy. Not to mention I cannot use my iCloud account they might be wipe any time between now to eternity.

I am thinking about email apple executive directly (Eddy Cue? I thought he is the one responsible for iCloud)...but I am not sure if I will ever get a respond.
I am also thinking about contact local TV station and consumer protection organization to tell my story.

What do you guys think? Do I have a case? or I am just being paranoid? any ideas?
