Here's my predicament/question:

History: I bought the 1st gen right before the 3g came out and Apple gave all 1st gen owners a credit whenever we decided to upgrade to the 3g (i didn't have to pay the higher price even though i was not signing a new 2yr contract).

Predicament: I bought my 3g 28days ago and i only have 2 days to return it to at&t store (30day return policy) before i'm stuck with it. My problem is that if i return it and order the 3g-S, i don't know if i'll have to pay the $399 (for the 16gb) or the $199 price.

Thoughts??

Call AT&T but whatever you paid for the 3G should be right around what you pay for 3GS. If you got 3G for $199/$299 then you should expect that.

I spoke with the AT&T store where i purchased my iphone 3g and they said that if anybody purchased an iphone 3g after MAY 9th that they will be able to exchange the 3g for the 3g-S at no charge.

That's what they told me and i'm gonna hold them to it on June 19th.

DO NOT WAIT until June 19th. When you finally go in on the 19th, there's a chance no one will believe you and refuse to allow the return/upgrade. Go immediately and at least get it in writing signed by the store manager of the AT&T you plan to swap at.

The policy has been released publicly. The OP would be fine.

For AT&T customers, the carrier has told MacNN that it will be extending its usual 30-day return policy to allow any customer that purchased an iPhone 3G after May 9th to upgrade to the new iPhone 3G S. These customers will receive credit for the amount they paid and will only be charged a difference in price if they decide to move up a model. To qualify for this extended customers must go to an AT&T store and order the iPhone 3G S prior to June 18.
