I ordered a new iPhone 7 Plus from the Apple Online Store and it came pre-installed with iOS 10.1 (not iOS 10.0). Should I be concerned the iPhone was a return or something? Can anyone who purchased an iPhone 7 after October 31 from the Apple Online Store confirm that their iPhone came with 10.1? Does Apple usually ship new iPhones with the latest available version of iOS?

For your last question yes. However, if what you get is a stock unit, rather than more recent one, you might have a chance to receive a device running iOS 10.0.
I got my first iPhone 6s Plus running iOS 9.2 while I was using iOS 9.3.2. I bought it at march 2016.

Not uncommon for the latest version of iOS to ship with the iPhone.

So basically you're asking if Apple is committing fraud by re-sealing used items and selling them again as new... thus easily opening themselves up for a huge consumer lawsuit?

Somehow I highly doubt it ;)

I feel like we're trying to find every reason to return our new iPhones even if it's so irrelevant to how we use the phone

apple doesn't repackaged phones. only the first iPhone and now can you buy refurbished units. and they say that they are refurbished. you got a unit that was manufactured recently and thats why it shipped with 10.1

was it just 10.1 and not 10.1.1 ?

It all depends when the phone was manufactured and the iOS. Apple will try to ship it with the recent os before it goes to the customer. Being that the demand for the 7 Plus is high, I take it that you will never find a brand new 7 Plus to come with iOS 10.0.0.
