New iPod Touch 2G arrived from Apple Online Store with OS 2.2.1, and, of course, iTunes wants to charge the $9.95 upgrade fee.

I could understand this happening if I picked it up from a 3rd party vendor who may have had it in stock before the release of new OS, but coming from Apple, months after new OS is released, is not in any way cool.

I have tried the feedback to get this resolved, but so far, not a peep. Tried their callback, and when it called back, received "All agents are busy"

Has anyone else had this happen? If you resolved it, how?

Apple doesn't offer free upgrades of the OS on older Touches.

The 2G Touch will never have 3.0 pre-installed.
 
same thing happened to me last week... really lame.. touch 3g will have 3.0
 
Happened before. 1G iPod touches never shipped with 2.0 pre-installed. 2G iPod touches won't ship with 3.0 pre-installed.
