Just got my new M2 Max 16" MBP, and the keyboard and trackpad are not responding out of the box. Unable to even go through the setup.

Best luck, it is to return to the store and show them the issue? Have it swapped?

Shouldn't have any issues exchanging it. Both of the Apple Stores I was in today had full stock of all models.

Mine came out of the box scuffed so I feel the disappointment.

Mine did as well! Right at the edge it is scuffed and a extremely sharp edge, I thought at first someone dropped it but you can see it looks like a machining error, I was going to just file it down but when looking at it you can see a color difference that I know with my OCD is going to drive me nuts so I’m going to see about getting it replaced.

Curious, which color did you get?

Mine was Space Gray which seems like it’s a little more susceptible to damage.

Have you tried powering off and starting again? Or connecting a USB keyboard/mouse?

It might just have 'stalled', i've had macOS setup assistant do that to me before.

I tried that and multiple other things and was never able to get the keyboard or trackpad to work. A Magic Mouse and keyboard would work but never the built in.
 
Yep, mine is Space Gray as well!

Kinda has burned me on getting Space Gray for anything that isn’t cased.

I ended up returning mine and getting silver. Picked it up this morning and opened it in store to be sure. Zero damage.
 
Physically take it back to the Apple Store if you can (and be polite but firm that you need to walk out with a working laptop). I had a similar issue with my M2 Air (the keyboard and trackpad worked, but the display wouldn't turn on). It was a manufacturing defect—a torn display ribbon cable—and they upgraded me to a more powerful machine because it was the only one they had in stock.
