I really don't think it matters what the T&C's say at the moment, I can't see Apple wanting to p*ss off all the current "official" iPhone owners by telling them they can't get iPhone 2.0 without paying ridiculous charges.

Apple has always been good about not p*ssing of early adopters. From the $200 price drop to the iPod Touch apps to not letting 5G video iPod's use the video rental store, we know Steve really cares.

Maybe they will give out Apple Gift Cards again.

1) The price drop was expected.
2) The charge for iPod Touch Apps was done to prevent accounting irregulararities.
3) The 5G iPods not playing rentals is due to copyright protection (as the 5G has no encription to prevent people from recording from the output, all the new ones do.

It would be nice if O2 had the same rules at the US mobile operators, you buy a new phone with the same company, there is no termination fee, you just start a new contract (unless you buy it at full price).

Actually, Android should be the name applied to Apple apologists who try to defend even the absurd that comes out of Cupertino. And such people wonder why Apple owners/defenders are derided by so many.

Its amazing how many reasons Apple find to charge fans just a little more.
 
For all those worried about losing/breaking their iPhones.. there is a thing called insurance that seems to be pretty wicked... ?

However, I feel that when a new iPhone is announced surley O2 will give out a new set of terms etc to go along with for existing customers. I'm also pretty sure that Apple would prefer existing users to buy a new version of their iPhone.. so with O2 creating f*ked up terms, this would obviously piss of Apple maybe?
 
Presuming that you signed up on the old terms, I dont believe that the change in terms (which is very material) would stand up to a legal challenge, so i wouldnt worry too much.

I was also a little suspicious when o2 "upgraded" my contract and noticed that the clause had been removed. I called o2 and they said they would email me with an answer. Still waiting. (Up to now o2 have been very good in terms of customer care)

Pretty sure I kept a copy of the original t&c.

The only reason I was able to purchase the iPhone 1.0 with confidence was the the clause in the original contract. If they've done away with this and expect me to pay termination fees in order to upgrade (to a REAL iPhone 2.0 not just 16 GB), not only will I take legal action but my new phone will be hacked.
 
I get the impression that this clause was in place to cover the circumstances where a new phone is bought to replace a broken one without taking a new contract. They probably put it in to cover like for like replacement without considering what it might mean for those people replacing the phone with a newer model. As it stands I would wait and see rather than grumbling about something that is far from set in stone.

I got my iPhone from Carphone Warehouse 4 days after the release. Before I bought it I checked the terms on the O2 website and it was the same as detailed by OP. In Carphone Warehouse the sales man tried to sell me the insurance, to which I said "well I'll just buy another one if it is stolen or broken". He responded telling me that if I did get a new iPhone, I would have to take out another contract, and pay for both contracts in parallel (along with other blatant lies, like I could use it as an iPod out of the box, and Apple had loads of other applications that I could install, including lots of games :). I was swaying, but I had read this before and didn't believe him.

Sure enough saw on the news and got a letter from The Carphone Warehouse advising that some of their sales people had a misunderstanding of this and "to make it perfectly clear, all I would need to pay is the cost of the new phone on a new contract and the old contract would be canceled".

I presume this is the same with an upgrade, or maybe some 8GB iPhones may be falling into ponds ;)

BUT.... if I take out a new contract, I will have the new terms in future... I thing I'm gonna wait for 3G and make it worth while...
 
... As much as I'd like 3G I don't think O2 are ready for that in their 3G network coverage at this moment ...

In my experience, O2 have a better 3G coverage than their EDGE coverage. I had been using 3G for 2 years before my iPhone and got a strong 3G signal throughout my train journey home from work. Now I only get EDGE for 20% of that journey. :rolleyes:
 
A little off topic here, but does anybody know if an american iphone bought in an american apple store, can be activated in the UK on O2 via itunes?

It's just that I have to go over there next week, and would consider getting a 16 GB there. A bit cheaper than it will probably be here when it comes out here.

No, your contract will stay the same, all you need to do is transfer your SIM as detailed on our website



Can I give my 8GB iPhone to someone else?

Yes – and they can buy a SIM from any O2 retail store for just £4.99. They will then follow the full activation process, creating their own 18 month contract and account with O2



Can I upgrade my 8GB iPhone to a 16GB iPhone without having to purchase it?

Sorry, no, we are currently not offering this option.



I bought an 8GB handset in January– can I swap this for a new one?

Customers who have purchased an 8GB device within the last 14 days can return them in line with standard O2 / Apple returns policy.



Please note – customers who purchased through The Carphone Warehouse can only return their iPhone within seven days of purchase, and only if the device has not been activated (unless the customer is declined and they have proof of this)
