so idk whats goin on with my iphone 4s i've tried backing up syncing and re-syncing cant restore unless i update which id rather not can anyone help

Take everything out of your camera roll and delete all of your texts. Those are usually the two biggest things.

I get this, but shouldn't pics go under photos bar? I've never really delayed texts, do you think it could take up more than a GB?

Only photos synced trough iTunes shows up in the photos section. Depending on how many picture and videos you get from texting/iMessages, you could hit 1GB.
