Passcode help

Hi! This is my iPod in trying to set up for my MIL but when I turned it on I got this message. It won't even let me type in my passcode. When I connect to iTunes it tells me I need to enter my passcode, which it won't let me do. Anyone have any thoughts?

Have you ttied this?
Disconnect and turn off iPod
Restart computer
Turn on and connect iPod

Is it registered on an icloud account?

Q2: did you come by it legally?
Q3: why do you refer to it as "iPod", as the image clearly states "iPhone"?

About q3,it's probably some spell checker that called it "iPod"
