I have two new iP4's that are having trouble with the headphones just changing the volume level while listening to music, does Apple replace these, and if so do I have to make a Genius appointment just to get new ones?

I liek using these at the gym I really would rather not spend a ton of money buying another brand.

They will and yes you have to make an appt. I had the same problem last summer and they just opened a new box and gave it to me. There are no "refurbished" headphones.

Same thing with the charger cord too.
 
You can also use the Online Service Assistant to set up the repair yourself, or call AppleCare (800-275-2273) and have one of their agents set up the repair. Be prepared to offer a credit card number, one may be gathered to secure return of the headphones if its above a particular $ value.

there aren't refurb. headphones, but they do have ones out of box (but still wrapped up) to give to customers who have issues.
