I've recently been having problems with the hold button my 1st gen iPod Touch. Sometimes it works, but most of the time it doesn't.

I didn't purchase AppleCare, so am I not under any guarantee from Apple? If I take it to an Apple Store, will they charge me to fix/give me a new one?

My 1st Get touch has just started doing the same thing - the top button doesn't seem to do anything. When did you get your touch - it may still be just under warranty (I did a warranty check on Apple's site and mine runs out on 10th October. I don't remember exactly when they first came out but I got mine not long after).
I'm going to take mine into a store for warranty repair, but if yours has expired there will definitely be a charge - they may also offer you a new one at a discounted price if you trade in your broken one.
