Proximity sensor not working

no, i literally just got it out of the box and was messing around with it. Siri told me i could just lift it up to my ear to talk without pushing button and thats when i noticed the screen was not shutting off when i did that nor could i issue commands to siri

Have you tried doing a simulated battery pull?

Holding the home button and power key for 15 seconds?

If so, try hard resetting it. If it is still broken then the proximity sensor is bad. I Would go to your carrier and request a DOA.
