Here is my story, I am a switcher that order on March 14th of this year a 17" Penryn HR 2.6GHz MBP. I received my mbp very quickly but found a scratch on the lid near the lit up apple icon, I called Apple and they told me it was cosmetic and nothing they could do. I then informed them I don't want it, I want it exchanged which they did. I then received the 2nd mpb and this time I have a gouged caps lock key and gouging on the lcd panel near the hinges. I thought maybe the Apple store could replace the lcd bezel and caps key, but they told me again exchange it for a new one. I am now waiting on the 3rd mbp to be sent to me. Is there anything I can do or any compensation I can receive for paying $3500 for the mbp and yet able to use it? Its coming up now on a month and just tired of the exchange process. I am not even getting them powered up I pull them out the box and check them over and make a call every time. Any suggestions?
 
Not sure about the US, but in the UK we're allowed to return goods we purchase for absolutely any reason since Apple offers us a 14 day exchange/refund period. Does this not apply in the US? (assuming your in the US)
 
No, I believe you can and I have, but just tired of the swap out. Just wish I was able to go to store and pick it out and verify its in good condition. I am not able to because its a custom built machine.
 
Since you said you bought the 2.6 HR, you can go to the store for that model. Also as with a refund, when you get the new replacement, don't open the box at all and immediately return it and request a refund.
 
Well I want the mbp just not damaged. I went to the Apple store and was hoping to get it fixed/parts swapped out but they told since it was a custom build and or so new he said you would have to go through the website and do a full exchange. The custom on it was from 2.5 Ghz to 2.6 and the hard drive from 5400rpm to 7200 rpm. They said they didn't have any to swap them out at the store (Mall of America Bloomington, MN) So its all packed up waiting for a return pre paid fedex label. Just feel at some point of frustration Apple should comp something. Apple store gift card? I don't know somethihng. I know FedEx making some good $$ on all this swapping out.
