If nothing back after the ten day period, will definitely contact PayPal. Not sure what proof he could provide in his favor. The item was sold as new and evidence all seems to say otherwise - "N" model number, device/box label mismatch, warranty status/issues, mfg date. Plus, that it was correctly listed as an A1524 when A1522 was incorrectly printed on the supposedly unopened box seems to rule out a simple mistake (to me anyway).

Swappa allows feedback/ratings to be edited. So, I modified my original positive comment/rating accordingly. Initially, I had said transaction went smoothly, item as described, etc., etc. Now, I modified it to say things seemed good initially, but have now found item was resealed rather than new and in process of trying to resolve.

After 10 days PayPal should remove the money from the seller's account and give you a partial or complete refund. It's in the seller's interest to respond to PayPal or they'll lose the money and their product.

Thanks for the info. I wasn't clear on what exactly the significance of the 10 days is. So I can't imagine why the seller is just not responding at all. Unless he's holding out in hopes that I will give up and just ship the phone back outside of the PayPal process. If that's the case, really confirms that he had plans to pull some stunt had I worked with him directly. If he's honestly wanting to make it right and accept the return, how hard is it to accept the return through the PayPal process?
[doublepost=1465797422][/doublepost]Also, is the attached legit for a 6 Plus? I thought that the 6 and 6 Plus boxes were entirely white and just said iPhone on the side. The one I bought came in all white, but this is another of the seller's listings. Did any of the 6 Plus models come packaged like this?

Yes it is legit, apple did change the box for the iPhone 6/6 Plus sometime ago to add a bit of color to it. If you scroll all the way bottom here http://www.apple.com/iphone-6/specs/ you can see that Apple have updated it to be colorful.

Ok. I searched online, but only found the all-white ones. But even on the one pictured there, it still just says "iPhone" on the side. Did they also change it to say "iPhone 6 Plus" at some point? Maybe when the 6S was released?

EDIT: Nevermind. Found this...

[doublepost=1465831217][/doublepost]Seller finally responded via PayPal dispute. Said he could offer $50 refund/adjustment or accept return for refund. I still don't understand why if I want to return and he's supposedly willing to accept the return, he doesn't just accept the return via PayPal.

I declined his $50 offer and status now shows "Being reviewed by PayPal".

Good move. You need to stick with PayPal at this point.

Well, PayPal found in my favor. At one point, I had thrown out that I would consider $100 refund to keep the device. PayPal just went with that.

I honestly would have preferred just returning for full refund, but better than nothing. Definitely could have ended worse. Suppose returning could easily have led to seller claiming returned device wasn't one shipped or wasn't in same condition, etc.

That's not a bad deal. I just hope they do something to notify SWAPPA of how shady that seller has been.

Ok. Final update/report. Updated Swappa of status of the situation via sale page. Seller responded making it sound as though I wouldn't return and insisted on a partial refund, instead. Posted one last response saying that was false and that all I had ever wanted was to return the item via the PayPal system.

Apparently no action against seller from either PayPal or Swappa. Seller still has multiple listings on Swappa. Three more are "new" "sealed" listings just like I purchased - most likely repackaged with fake labels like sold to me.

Also noticed on the box that it is very obvious that the fake label was applied about a millimeter off from the original. You can see the outline of where the original label was because the left-over adhesive not covered by the new label is collecting dust/dirt.
[doublepost=1466005012][/doublepost]Also, attaching one last version of the label just as an example/warning to others. I honestly didn't realize people were going to these kind of lengths on scamming. All extra effort just to list as "new" rather than unused warranty replacement (which I think it was) or mint.

1. thick, blurry, low-res text with rough edges (photo is properly focused)
2. serial and IMEI poorly aligned with surrounding text
3. wrong model number and part number
4. full 15-digit IMEI rather than 14-digit ESN
5. possibly junk bar codes (readers/converters unable to convert to numbers)
6. questionable UPC
7. exposed adhesive along edges where new label is offset from original label position

Even noticed later there's lint and fibers trapped under the label!
