Question about the return policy for iphone 3gs

    I'm trying to find buy an iphone the 3.1.2 so i can jailbreak and unlock it but i heard the chances of getting one from the store are pretty slim... So my question is: Can I buy the iphone at the apple store without contract then open it to see what version it is and if its 3.1.3, return it for a refund? I don't mind paying the 10% fee if its really possible.

    I got lucky. I just bought a refurbished iPhone from Best Buys and it's a 3.1.2.

    I have heard anything after week 40 in 2009 is hard to jailbreak.

    I would suggest buying a refurbed one from Best Buy.

    The cost was $150 with 2 year contract extension and a 30 day return policy.

    I'm want to unlock it to use it with tmobile that's is why i want to buy it at the apple store since they no longer require you to have an att contract...

    I think your best bet is getting one off of ebay or craigslist. You'd have to get extremely lucky to get one at the Apple Store.

    Why not try to be honest for once?

    Just go into the Apple Store, explain your situation and ask which OS is in their 'phones and if it's the "wrong one" for you you won't have to try to con them into a refund.

    isn't jailbreaking illegal? i dont really think asking them if the phone is jealbreakable a great idea....

    It's not illegal.
    It just voids your warranty.

    The Apple stores around me have been 3.1.3 since before week 7, 2010, so mid February.

    There's no indication on the box for the employee to know what version is on the phone.

    Since the full-priced ones are sold "unopened", I wonder if they're subject to the normal 10% restock fee?

    Subsidized iPhones are opened by employees in the store (after purchase), to activate for the customer before they leave. They can't (and don't) charge a restock fee for those.

    Please explain how he is trying to con anyone. It is his right to return the phone if he doesn't want it.

    Yep, its a real con having to pay a 10% restocking fee just to try to get an iphone on 3.1.2:rolleyes:
