re: JB/Unlock 3GS 5.12.04 No Data Plan for Resale?

I sold my 3GS on ebay without wiping it clean and do not have data or service anymore. Is there a way to restore it and then rejailbreak and unlock it without a data plan?

It is running IOS 4.0 with a baseband of 5.13.04.
