Hey

My 2016 MBP non touch bar with function keys and two thunderbolt ports has had continuous different failures. Under my countrys law, Apple have agreed to replace it with the current mbp with touch bar and same other specs.

I have one issue which is the new one does not have function keys and I am a developer who uses the functions keys primarily, what shal lI say to Apple?

Any advice please? I will be speaking to my advisor later today.
 
You should tell Apple you are a developer and use the function keys primarily, and then see what they suggest?
They will generally try to give a like-for-like system as much as they possibly can, which fulfills their legal obligation. Not sure if you can dictate exactly which system you are after.....unless they let you top up with a payment for a specific system....

Initially they did meniton i can add extra options, but im gutteed that they dont do a non touch bar pro as a base model!!!

They probably don’t have any more, since the non-Touch Bar model was dropped when the M1 MBP came out last year. The 13” M1 MBPs still have the touchbar.

Yeah it was, I wonder if they'll give me the 14inch base line mbp which has touch bar, will have to speak to the advisor.
 
The touch bar does show the function keys if you want it to.
Obviously, they aren't hard, dedicated keys but they are all there when you want them on the touch bar if that's what you choose.

Or use an external keyboard? Yeah, should be embarrassing for Apple to have people not able/willing to use their notebook keyboards, but they continue, oblivious...

I guess it depends on how badly you want function keys, physical keys, and what Apple can do for you. I have used external keyboards before with MacBook Pro notebooks. Hopefully they come through for you. Apple seemed to be trying to wag the industry, again, and eliminate function keys. The world does have a use for them, and Apple relented and brought them back.

I've never owned one, so I don't know if the touchbar can be set to display the function keys "as the default".

Another possible solution:
You could plug in a USB keyboard with function keys, for when you need them.
Should work in recovery mode, as well.

Apple will try to make like for like in machines BUT they are not legally responsible to do so. Legally all they have to do is get very close to the machines original spec and then it is up to you to accept it or not. If having functions keys is a must then by rights you should refuse Apples offer and take a full refund instead.

is the m1 air and m1 macbook pro the same? whats the difference?

I am not familiar with your country’s laws and I am not an attorney but depending on the wording of the applicable law, you may be entitled to a “functionally equivalent” replacement. Again I am not an attorney so don’t take this as legal advice. If you need to really push the issue with it’s Apple consult with an attorney from your country.

The Air is also down-clocked, it runs slower, to keep it cooler. Big tradeoffs with the Air, but it's skinny, light, and...

Apparently it's not what it used to be.

Performance I’d almost the same especially if you get 8 core model….no major trade off and you get real function buttons

I remember years ago, the Air's were anemic and woefully slow. At least that is what I remember from that time. People didn't like how slow they were. *shrug* Maybe Apple learned something?
