Hi,

I've just bought a second hand iPad Air, and I stupidly forgot to check that he'd signed out of iCloud. It wasn't signed out and the seller's now told me that he doesn't have the password.
It's probably not stolen as he also gave me the box and receipt, and I picked it up from his house but it's obviously not an ideal scenario. Also, whilst it works fine, it's also on iOS 7.1.1, so I'm not even sure if I can upgrade the OS from now on.

1) Is there any was I can sign out/remove the old iCloud account from the device, without the password? Are there any jailbreak tweaks that would allow this?
2) Can I at least upgrade the device to iOS 8.4 without the iCloud password?

Any help or advice would be greatly appreciated.

You must get the seller to turn off and sign out of iCloud.

Do I also need the password to upgrade to the latest version of iOS? I don't need to restore a backup or anything like that. I'd just like to have iOS8.4

If the iPad is still signed in to iCloud it's trivial for the previous owner to lock the device and render it useless to you at any time.
 
Just to confirm, I bit the bullet and did an OTA update on the iPad.
The update competed without any problems and I could simply skip the "sign into iCloud" step when the iPad stared up.

nope. you can't remove the account without the password. Apple won't turn off the lock without a original purchase receipt that has your name and the serial on it.

as far as hacks, not unless you can find a hack that will make it not contact the legit server. But you would also have to find a way to send the correct signal to the iPad to make it think you put in the correct password.
