Read the update:

Upon further discussion, it's unclear whether the code in question will shut off all jailbroken phones or just those that have been unlocked from AT&T to run on T-Mobile.

The unlocking crap was already discussed in another thread. It’s not going to happen either for obvious reasons (they’re not on AT&T!!), so that whole article is probably bunk.

wouldn't that be illegal anyways... it's your choice what you want to do.. so if they catch you big deal.. and more if you bought the phone with a non up-grade!

Common sense (and simple code inspection) shows that "leak" by "Alpha" about iPhone4 OTA re-locking to be silly FUD.

There is no OTA upgrade code in iOS 4.0.

Apple alleging that the new iOS will, among other things, detect whether an iPhone has been jailbroken and unlocked - then require that factory approved software be re-installed

How can it? The iOS is whatever the Jailbreakers make it.

They will somehow stop it checking or make it think it's a legit OS.
