Hmm...

See all that dirt/pocket lint in the corner? (You can see it pretty clearly in the pic on right showing the top) That's evidence of the phone being carried around for quite some time...looks like many months of lint to me. Not sure what they did to the top either...maybe it got scratched/nicked from being carried around with keys etc.

Anyway, this phone is clearly not at all what was described. Those pics are clearly stolen from that link too...the macro shots of the keyboard...

Wow..sorry this happened to you. Hope that Paypal moves fast to get you your money back. (They tend to take their time handling problems from my past experiences. I'd call them and nag them...)

I've just filed a claim of my own. Sent a fake memory card back on the 2nd (thankyou, Recorded Delivery), arrived on the 4th and the seller hasn't been in touch or refunded my monies. *le sigh*

I'm still waiting for paypal to decide on the claim. If you're willing to give me the full refund you can call paypal and settle the claim that way. I just got off the phone with paypal and they advised me not to send the product back until they've settled the dispute. That way they can track the package, make sure you get it, then make sure I get my money back.



Also the guy I talked to said it looks like it's being reviewed now so I should get a settlement shortly (regardless whether ajagger00 calls to settle)
 
Did you definitely escalate the claim because day 20 is the last day you can do so and if you didn't it will automatically close at the stroke of day 20. Other than that you have photos of it, possibly take a video with your digital camera etc if it can do videos and put phone on speaker phone so it picks up the squeal and link it in the paypal claim if possible.

Good luck with your claim. I had to recently claim also, as some idiot ripped me off £230 for an iPhone on eBay. I escalated it immediate and took them 15 days to give my money back (they had many claims against them also which probably made my claim quicker I guess since he ripped off more than 100 people!)

Soooooooooooooooooo it looks like Paypal took the money out of his account and is holding it until the review is done :) That makes me at more ease as he can't run off with my money (and I doubt paypal would run off with my money o_O )

OOOOOOOOOOOOOOOOOh now I get the "account is in the negative" part. I thought he meant since he got a negative score from me. He means his bank account is in the negative.

I tried to record the squeel, but it's like those "teenage ringtones" that only young people can hear and my macbook mic isn't terribly good. I do have the best recording of what I can get, but the ambient noise of my apt makes it sound muffeled.

I'm now avoiding buying/selling on eBay, unless it's something being sold by a fellow Apple collector.

My friend sold a nice antique truck mint complete in box for a friend of his. The buyer said it wasn't as pictured and tried to send back the same truck but it seemed (by the buyer's description of what was "wrong with it") to have been bought at a flea market (and no box/instructions).

My friend said no, then the guy not only wanted the money back, but not send back anything at all for his problems.

That made PayPal side with my friend, because it was very suspicious that the buyer just wanted his money back without sending anything back to the seller.

I'm afraid to sell my old DVD sets as well since I've heard horror stories that people would lie and complain about the DVD's (missing, scratched, bootlegs but they are retail ones), Paypal would side with the buyer and your out the money and the DVD's.

Now, I just trade in my old DVD's to a local store, less money, but at least I get something.

awww, boo hoo. poor baby! Maybe next time he'll learn to not screw someone over on eBay

Alright, Paypal got ahold of me yesterday (30 days on the dot! How efficient :p) And I sent my phone in today. I sent it out UPS with a Tracking number 1Z03WR764297454184. So hopefully I'll get the money by the 7th (when the package is expected to arrive @ dest.) :)

Oh no, I went ahead and bought another one from someone else. I needed a smartphone. Just because the first one was crap doesn't mean I can't buy a second.

And I shipped the phone to him via paypal. Here's the newest report

I called paypal and if the seller can't be found then the phone gets shipped to me and I get the money anyway. Which is pretty weird, I do hope they find the guy, because I don't want the duty of selling a broke phone.

Sooooooo I'm getting the phone back. :-/ I also called paypal to check if I'd still be getting my money back and the Agent said that there STILL isn't a valid tracking number. :rolleyes: Sooooooooooooo with some rummaging around he found it in the notes and apparently the last TWO agents put it into the wrong field -_- He also said that the case, since it's been reopened and is in appeal will have to be reviewed by the experienced agents (top-tier or so) so I shouldn't expect anything until wednesday. I told him to leave a note in there for the experienced agent to call me. This is upsetting :(
 
A new update.

Paypal asked me to send in some faxes proving that I shipped the package on the 22nd of Feburary. I complied and got an email confirming the faxes were received. The email then said "please wait 3-5 business days while we review your documents." It has been 7 Business days. I called Paypal and all the Agent said was that I just had to be patient and there was nothing he could do.

FINAL UPDATE:

Well, hopefully final - the case is closed at least :D
January 3rd - April 22nd the case is finally closed.

And it was the woman on the phone who closed it for me. She did leave me on hold for 3-4 minutes though - possibly to talk to a supervisor.

Anyway, no use leaving you all in suspense. The verdict! I am getting the full $332.49 credited to my cc. Not only that, but I get to keep the phone as well! Not sure what to do with it though, I'll definitely sell it but will say it's for salvage or parts only (probably needs a new screen digitizer, which are about $100).

Haven't heard from the seller since February so I assume there's no more correspondence with him. I did send him a message on ebay saying they decided in my favor in case he was curious. But unlikely I'll hear back from him.



As a sidenote, once I get my cc credited - I will deactivate my paypal account. Maybe ebay too since they're the same company, and since pp is so intertwined with ebay. We'll see :)

Now the only dilemma is do I sell my second Wing* and combine it with the amount I'd get from the first Wing and buy an iPhone with it?


*Just for the record, I did buy a 2nd Wing after I found out the first was rubbish. It's fine despite being all Windows Mobily. I actually got the Wing over the iPhone because I didn't want to have to hack a phone to have to use it. Little did I know that Windows Mobile needed to be hacked as well just to work as advertised. Sigh, now iPhone unlocking seems realtively tame to what I've done to this Wing. Oh XDA...
 
YAY, checked my CC online and had 332.49 deposited directly into it :)

Whew, that chapter in my life is over. I think I'll check craigslist so see if anyone wants the phone, then they can show up and see if they want it (inspect it out first).

And yeah, I'm pretty gullible - but at least I'm persistent about it :p
