I'm planning to return my iPhone 5 tomorrow and go back to my iPhone 4. Will Apple check the condition of the handset? I'm assuming they will, but just thought I'd check.
Reason I'm asking is because some of the aluminium has chipped across the top after it catching the button above my jeans pocket.
 
Most likely but with all the chips bezels coming out of the box unless it's obvious consumer damage they will likely let it go.
 
almost certainly. However, they may be lenient about it what with all of these so called 'cosmetic' complaints they must be getting at the moment.

Just clean it up and put it in the box. The don't give a crap.
