The iPhone 5 I got from Best Buy had scratches out of the box. Immediately took it back to Apple for a new one. It really is unacceptable for merchandise that's supposed to be brand new.

We obviously have different opinions of what is acceptable.

If I was buying some fine china or artwork, then yes scratches/damage would be a problem. But a smartphone is a tool that's supposed to be used, not admired. Scratches and minor cosmetic damage doesn't impede on the device's ability to function as intended, so there's absolutely no point in exchanging it IMO.

If you swap it and get a device with no scratches, scuffs or blemishes, that won't make the device work any better!

So basically i can get a new iphone 5 during the 14 or 30days? swap it out?

It depends on the policy set by the store you bought your phone at. In this case it is BestBuy.

Wow. This thread gave me a headache.

Why don't you look at the receipt, call the phone number and ask them what the return policy & procedure is?

Nope.
You will have to buy another iphone, put on the screen protector from that one to yours and then try bring it back.
Or maybe put on some clear duct tape on the screen and hope they wont notice:D
But that plastic protector has a serial number at the edge that sticks out so if it doesnt match your box they wont take it back.

Can i buy apple care anytime i want?

AppleCare can be bought within the warranty period (one year). AppleCare+ must be bought at the time of purchase, I believe. Maybe 30 days after that as well.
 
I've just bought an iphone 5. It has no scratches and works fine. However, I realize that it has a light leaking at the top of the border near the power button.
Looking at the phone now is uncomfortable. I decided to return it back to apple store. I would rather accept the scratches than the light leaking on my iphone.
So If the scratch is acceptable, just keep using. The new one may be worse.

Dude... srsly ?

You can return the phone in 14 days if it has flaws out of the box - from the factory ; if you damage the phone later you can't return it.
The 1 year warranty covers hardware problems like a broken button, GPS not working and so on.
You return the iPhone from the place you bought it.

Hey guys, I wrecked my car (faulty anodizing is what I blame), can I return it?

The warranty says it's good for 5 years.

That means they'll just give me a new one even though I made it hug a tree right???

Yes, you have a one year warranty so if something is defective apple will cover it.

Think of it like this. You buy a car, you have a 60,000 mile warranty if your transmission goes bad, that'd be covered. But if you scratched the car, you can't take it to them and make them repaint it. Same principle here.

I serach my serial number on the apple it says the support and service options

Send in for Service
Send your product to Apple and get it repaired or replaced.

It only covers hardware issues. You are trying to get replacements for cosmetic issues caused by yourself.
