You can make what you want from the charts.

An informed opinion can not be formed from those 2 pics cause they don't use the same scale on the vertical axis.

Really? Are Europeans cross with Audi, BMW and Range Rover? Are they angry with Toyota for making Lexus?

As far as German brands are concerned I'd have to say yes. In fact over the past few years it has become increasingly difficult even for Germans to buy new German cars. This probably doesn't apply to BMWs, Porsches or Mercedes. But VWs and Audis? They cost way way more than they've had in the past. Obviously this doesn't make them any less desirable but people have started investing their money in less popular brands like Opel, Citroen, Alfa romeo etc. The desire for quality and performance is still there but many people are now willing to settle for less than what the premium brands have on offer.

PS.: Over the past 10 years I've split my time between London, Frankfurt and Athens and I don't recall ever seeing a Lexus...

having just read 15 pages of this thread i have just thought ;

Why do we as consumers actually give 2 hoots ? is it the whole i bought x product so it must be the best in the world ?

If not why are people defending companies in most cases unless you are an employee they will not have heard of you , or care who you are or what you do ?

Just mind boggling people argue with people they have never met, over things they will probably never agree , companies get to have over $100bn in the bank and still don't give 2 craps !!

The whole patent issue is messed up , both parties are defending what they see as the right side , both its all just bull ..

My opinion , if anyone cares , is that both sides come out looking like douchebags in the end, waste bucket loads of cash, get some back off each other , and we still argue about glass or plastic cases on the phones ????

What a great life lol

Samsung has the money for lawyers. They are larger than HTC, and can afford the fight. I must say though, Apple is becoming a patent troll. On some issues, I side with Apple, but these other claims are absurd.

Patent business is the new iStuff. Great work from R&D team. You don't even need tech experts, you just need commoditized lawyers.

iPatent, iSue

Galaxy SIII and Galaxy Note II have already blown iPhone 5 out of the water, of course I know Apple fanbois are not going to admit this.
Do you understand what an opinion is?
Does samsuck even have a R and D team?
Samsung does indeed have an R&D team.
Whoa. Samsung's newest flagship toppled Apple's year-old handset in one quarter in which Apple's newest phone had something like 9 days to sell.

Samsung's definitely winning.

Explain good faith.

Where in the article does it say Apple is trying to settle?

Previous discussions broke down because NEITHER party would concede

Apple can be friends with HTC because HTC isn't a threat to Apple. And HTC can't afford lawsuits - better to pay per device when sold then wind up in court.

Apple's trying very hard. At getting as most out of Samsung as it can. And guess what. Samsung is doing the same.

Good Faith: Not issuing statements like "we will never settle" within 1 week of the HTC agreement.

Yes, yada, yada, HTC is not a threat. So what? It shows Apple willing to settle through negotiation at "this" point.

Apple will get the most in the end. I agree even more after todays filing.

Try to remove the first year as CEO, and look at the Executive Reshuffle as the beginning of Tim's first year. There very well could have been stipulations in the Succession Plan involving certain moves Tim had to continue, or could not act on for 12m. We have no way of knowing but it would fit SJ's profile, and things have changed dramatically since the 1yr anniversary.

In the end Samsung needs to go more Buddhist in their operations. They are too caught up in Confucianism. Bad Karma for 2013. :apple:

Maybe everybody is just getting tired of Apple's bullying and heavy handed tactics.

Not saying Samsung is without fault here. Their early Android phones did look an awful lot like the iPhone. But, Apple has borrowed as much, if not more, from Palm OS, Windows Mobile and Android, yet when they think somebody has copied or borrowed something from them they behave like the school yard bully.

So if you next door neighbor go into your house and take your food, it is not o.k. to fight back and get the food back? That is one nutty comments, Apple is accusing Samsung of stealing their design and IP and the court around the world are deciding if Apple has a case or not. That sound like a due process to me. So when Apple defend their own property, it is bullying and we defend our property, it is our right? How screw up a logic is it?

Hey, who would turn down free and invaluable marketing? Samsung is exploiting the trial in his favor using it as marking, not Apple.

I actually studied with a Director of Samsung in London who told me they pay people to go on to competitors websites and make negative comments, this would then draw an unhinged element to post comments favoring Sams**g on websites like this... a website for Mac, people are scared of Apple, because Apple has the best brand loyalty, hence the lines at a mac store hence they pay people to trash Apple. Scary stuff

samsungs forum trolling budget must be higher than that of their mobile devices r&d.

Really? the lines comment? Wow.

Well guess what. My best friend's cousin's brother's nephews great aunt once had pizza with the VP of Samsung marketing and he called the Director of Samsung in London a bit fat liar liar pants on fire.

Again - people need to use less tin foil hats. The truth is scarier to you than this fiction - which is - people can own and enjoy Apple products but also br critical of them. OH NOZ!

silly. first hand tales are much more believable ;) and i find his story more plausible than you owning and enjoying any apple products.

Apple is starting to disgust me. Apple with lack of innovation of new types of products had to shift their gears to hating mode. Keep your eyes on your projects, snapple!

You guys are thick skulled, seriously, someone tells me Samsung is not the market leader in ANYTHING... yet I just pointed out the electronic areas in which Samsung excels and OWNS nearly the majority of market share. Does the Samsung memory chips have Samsung on them? Does Samsung TV's have Samsung on them? Why do you think samsung sells such high volumes? Its because their is a demand for their quality and effecient products! Just like the iphone... is that a cheap product that appeals to the masses? Nope, people recognize a quality product. The free market dictates which of the strong will survive. The bottom line is, Samsung sells memories and screens, they reap the profits, they reinvest and continue to innovate.

Those arguing if samsung even has an R&D department... YES THEY DO, they actually invested three times more money than Apple this year. Why do you guys continue to ignore that samsung gets awarded WAY more patents in the US! Its not close, has not been for the last 10 years. You guys can hate on Samsung all you want, but nobody has rebutted the fact that Apple does NOTHING for the US economy except take consumer's money, does not pay much taxes, refused to build any jobs for us, stifles competition, etc.

Lol, love the comment in bold. How can you reinvent something that's already implemented? BTW, the first iPhone don't have an App store.

Just because it was already invented it doesnt mean you can't reinvent its implementation. Where exactly were touch based products when Microsoft came up with it? By your logic it's like saying "oh computer sotware operating systems were already invented before Microsoft, therefore you can't reinvent operating systems and the way its implemented in computers".

"Lol" I love your condescending comment based on baseless arguments. Truly shows your level of comprehension.

In the case of an apparatus patent, make, sell or use an apparatus that is described by the claims of an issued patent. i.e. do what you claimed.

B

And that is known as "practicing a patent"? Really? :)

The fruits of socialist policies. They have fairness and equality. In other words most everyone is equally poor. ;)

Seriously? I'm sorry, but Apple is the 21st century. You need to look beyond the US and see the big picture, here. Without Apple, we'd still be using phones the old fashioned way. Apple's contribution was to leverage technology to connect everyone and everything.

That's what this is really about, and what android fans like you don't get. I honestly hope it's illegal to own anything but an Apple phone one day. I really do. Apple invented this technology and all parasites like Samsung can do is steal from them.

A patent troll is someone who sits on their patents without practicing them and then sues someone who attempts to use the patented method or technology. You may think apple is overly litigious, but they do practice their own patents, so they are not a troll.

Sometimes Apple buys up (or ties up) other companies, so no one else can use their patents (or products). A couple of major examples:

In 2010, Apple bought perpetual exclusivity to use Liquid Metal for consumer electronics, thus denying it to companies like Samsung who had actually been using LM since 2004 in their phones. So far, Apple hasn't used it except for the SIM eject tool.

In 2005, Apple bought Fingerworks because of their multi-touch research, and shut down their product line. This meant the company's unique ergonomic products were no longer available (except used at high prices) to people with hand stress injuries. A loss for the public.

It's preferable that such patents/products be licensed out, than never used. In other words, sometimes paying a troll is better than having the bridge totally blocked.

What's crazy is that even if they copied something to a T you would probably say the same thing.

Actually I thought the old Samsung phones were rip offs of the iPhone, and the front of their first tablets. But since then, their software and hardware doesn't look like the iPhone or iOS (and thank god for that because iOS is so boring). I have no irrational hatred towards Samsung, or any other company for that matter. It doesn't affect me at all and if I don't approve of their products or practices I just won't buy their products.

Actually Apple has been the company that has irritated me recently. For me, their iPhone and iOS has been stagnant for awhile now so their constant litigations are pretty annoying (especially the ones about the stylus patents that Apple has no plans to bring to market (this is an assumption but a pretty safe one to make).

I'll always have a soft spot for Apple but I won't support what I believe are unwise decisions. Blind following is never a good thing. Its ok to call Apple out on their **** if they become too comfortable, which I believe they are.

Unfortunately for Apple, the judge in its case against Samsung in the US has agreed to review claims of misconduct against the jury foreman, who concealed the fact that he was the defendant in a lawsuit brought against him by a Samsung subsidiary and lost, which he told friends "ruined his life" and caused him to file for bankruptcy.

Another set-back for Apple is the US Patent Office invalidated 20 of its "rubber-banding" patent claims after the trial, including claims related directly to the case. This was based on the discovery of "prior art" that preceded Apple's patent application, proving it was not Apple's invention.

One of the invalidated patent claims was determined by the jury to be infringed upon by Samsung which forms much of the basis of the verdict. With the patent now invalidated, this throws the whole verdict into doubt since Apple should have never been granted that patent in the first place.

This leads to the question of how valid many of Apple's "design" patents really are.

Examples include Apple being awarded patents for something "that helps the touchscreen interpret whether the user wants, for example, to scroll up and down or switch between applications" and "allows the device to show an image on a screen with a second, translucent image over it".

No wonder the US Patent Office has been rescinding numerous patents it previously awarded to Apple. These examples are just ridiculous. The patent system was designed really for mechanical inventions, back when cutting-edge technology were electric lights, steam engines and the phonograph.

Now you can patent an IDEA or CONCEPT without actually executing it, or in these cases, writing the actual software for it. That's how Apple has all these nonsensical "patents" because they submitted every idea you can imagine, and weren't required to actually show working demonstrations of these "ideas".

The real issue is with what Apple is doing is they are basically trying to stop innovation in our world to further line their own pockets. Sadly most of the patents they are applying for they NEVER INTEND TO ACTUALIZE in a product. They only want to PREVENT any other companies from creating new products with these ideas so to block any profits for their competitors while they are trying to monopolize the market.

Sadly what this means for consumers is that Apple is preventing technological advances from reaching the market, meaning not only are the products available to us not as good as they can be, but that also we are increasingly given less choice in terms of product selection and being forced to choose only Apple given the US courts are helping them in achieving a monopoly in the United States.

It's worth noting that the US is the ONLY country where Apple has had any MAJOR success in their frivolous patent lawsuits. They have been defeated in the courts of practically every other country including a rather humiliating defeat in the UK where the court ordered Apple to post a humbling apology to Samsung on its website and in newspaper ads acknowledging Samsung didn't copy their designs.

Another sad fact is Apple now spends MORE money on lawyers, litigation and patent trolling than it does on research and development. They are paying lawyers and law firms literally billions of dollars every year on these lawsuits.

The really surprising thing is that Apple does NOT expect to recoup these legal fees even if they WON all their lawsuits. The BILLIONS in legal fees they spend every year DWARFS the potential damages awards they could win in these case. So the real reason they are suing is not for financial compensation but rather purely to prevent their competitors products from reaching the market.

How's that for "free trade". Rather than competing in the consumer marketplace by offering better products and value and letting the consumer decide the winner, Apple prefers to choose FOR the consumer by denying choice for the public and not having to compete by offering the best product.

On top of that, Apple has been refusing to PAY LICENSE FEES for using technology patented by other companies, and just lost patent lawsuits brought onto them by VirnetX and Motorola.

Oh, the irony! Apple is undergoing an ongoing crusade to stop its competitors from releasing their superior products around the world based on phantom "infringements" of their ridiculous "design" patents (most of them which are being thrown out and invalidated by the US Patent Office) and yet they are refusing to pay license fees to other companies for use of REAL technology patents?

Just goes to show what a two-faced hypocritical anti-consumer monopolistic company Apple really is. Sadly when once Apple was the anti-Microsoft, Apple has now BECOME Microsoft, Version 2.0.

Wow your tirade was quite exhausting to read. Stop being so emotional about something that really has no beating in your life. If you allow what companies do as a business to get you so upset you will always be an angry person. It's ok to express your dislike for something. Just keep it in perspective that in the end, it doesn't really matter.

I wonder how much Samsung pays people to come here and rebutt stuff said about them. These days it seems many MR posters are more passionate about defending Samsung as the greatest thing since sliced bread. Isn't there a pro-Samsung website/forum where you could do that? Why would anyone come to a site called MacRumors to read about how great and wonderful Samsung is?

0 dollars.

Apple, Microsoft, Samsung, LG, ect. Don't care about sites like this, the impact a place like this has on a companies sales is pretty much nothing. The average consumer does not come here.

I would fall into owning a Samsung Phone, a SIII, which I like very much, I personally think its a better phone than the IP5, but thats just my opinion ( I perfer the larger screen, and I prefer Android to iOS at this point in time, and swappable batteries is a must for me ).

Lots of people here don't own, nor have interest in owning an iDevice, but they do own this thing called a Mac, I have a bunch of Macs....so I come here....hence the name... MacRumors....

These guys play hardball. If Apple wants to settle, Sammy want them to beg.
I wonder if apple really knows what they’ve done, embarrassing several chaebol execs in front of the world like that... this isn’t probably going to be over for a long while...

Nice try, wrong, but still nice

Um, how was that wrong? It's the NOMAD Jukebox, right?

----------

really?, do you know how much of your Apple devices made by that "Washing Machine Manufacturer"?

Actually, I do. By volume, it's roughly 0.8% of my iPhone 5. 1 chip.

According to iFixit, if we were to credit the majority of my iPhone to a company other than Apple..... it'd be Sony. (battery.)
