i don't know about Paypal's rules in the UK, but in the USA for something like an iphone you need to send it with signature required and not just a tracking #

I sent it by Royal Mail Special Delivery, so I have a tracking number and can see online that it was delivered successfully and can see the signature. I also have the paper receipts from the Post Office.
 
What I would do, after paypal release the funds, would be to withdraw the money, wait, close the eBay account and then report the phone stolen using the IMEI. Teach them to try and scam you, play them at their own game!
 
Thanks guys, I've submitted everything to PayPal and just waiting to hear back with a decision.

May take up to a week for them to make a decision, so try not to stress to much. Yeah, I know, easy for me to say. It certainly looks to be favorable for you though. If they try to claim anything but their original statement of claim, just remind Paypal what that claim was about. Do not let them stray away from it. Stick to your guns and good luck!
 
Worst case scenario if they rule against you then I would report the imei as stolen. The carrier will lock the phone and the person will not be able to use it. At least you will get some satisfaction.
 
If you use common sense and meet in public places, the chances of having a problem are slim. Sure, anything is possible. You could get hit on the tuches by a meteor just walking down the street.

There was a thread not too long ago where someone took off in a busy public place. So much for that. There's also the problem of bait and switch which works best in distracting public places.

I was covered by PayPal's seller protection but I saw the buyer still made a further claim it wasn't a genuine transaction. Remarkable! I don't know how they get away with it?!

There was a case a couple of years ago where someone had obtained my card details and bought a game online. The merchant gave me the delivery details, name, address, phone number. I reported it to the police and filed a report but they didn't pursue it as they don't have the resources and since the bank refunded me for the transaction they become the victim and I become a witness. And the bank's choose not to pursue it.

Maybe I'm in the wrong line of work!

And that would constitute fraud.
 
Not if the seller hasn't got the money for the sale - that would technically be considered a theft!, Glad PayPal came through in the end though.

So he would tell the insurance company that he sold it on ebay and did not get paid. As long as he tells the truth, then its not fraud.
