yeah if they really can't fix it or it's not worth it for them to fix it and it is still under warranty and they do not have any more 2g in stock they will most probably send you a 3g... unlikely tho...

For iPods and iPhones Apple has two different types of parts. Service and retail parts. When something is wrong with either and iPod or iPhone that is not software related, apple will replace it, apple never repairs these types of products. When the product you own is no longer sold but is still under warranty it is replaced with the EXACT SAME generation. Believe it or not, Apple still carries the first ever iPod as a service part, if your willing to pay for an out of warranty service replacement. So therefore you will NOT get a 3G iphone even if its competely dead.

I could be mistaken but I thought I saw a thread here where someone did have their first gen iPhone replaced with a 3G.

I read that thread too. He had to have his phone replaced like three times. I'm sure that makes an exception to the rule.

By law? Seriously? UK or US, cite it, because this is something I've never heard.

I would say you could get a 3G if the repair center it gets to doesn't have what is needed. If it's in their best interest to give you one, sure. Depending upon the issue they may just junk it and go. I do believe there is a nice stock of refurb 2G phones anyway.

My question though would be if you do happen to get a 3G phone you'll likely have to increase your plan, I wonder if you have then enter into the contract. Sure, you wouldn't have to pay the $300 but you may still have to renew your contract to get the 3G plan. Maybe I am wrong.
