iPod Shuffle will not turn off

i have a new 2g ipod shuffle. the off switch will not work. I can still play and pause it while it is supposed to be off. i reset it to factory settings, made sure the software was up to date and loaded all new songs. nothing seems to work. is

should i just take it into the apple store?

Let the battery run down to zero and keep it unplugged for a while.

THEN, fully charge it and do the factory reset - you know there's a special one just for this model, right?

THEN, see if it works.

If none of that fixes it, the Apple Store is probably a good bet...
