sideloading apps (Uber Partner app)

So riddle me this.

I've started driving part time for Uber and as such one has to manually download their app, not from the app store but from a link they send. This is basically side-loading apps. How is this allowed by Apple and why don't jailbreak devs use this method to get their wares out there?
