since when are apps allowed to change the brightness settings in their app?

Didn't the Kindle app do this via an overlay that it made lighter or darker depending on the setting?
 
Yeah, I have a few apps that either add a dark overlay, or just darken the graphics. They can dim the screen, but not control the actual brightness.
 
ok because I was really confused and thought maybe it was a feature that they tried to get away with.
