I've noticed that somehow, 9.66G of my ATV is filled with the "Other" category.
As it is, I only have my music library - around 6G - and a few movies synced with it.

What is the default size of the software on ATV? 9.66G seems pretty bad, especially for the 40G version.
 
No rentals, no modifications at all.

The only thing other than direct videos or music that I've used has been streaming a few trailers.
 
Only way to know for sure is to gain access to the ATV's hard drive, either by ssh or pulling it and connecting it to your Mac.
 
I restored to factory settings, got the update, and the software size was down to around 38 megs.
After loading my files on, it's up to 113.3 megs.
I assume this probably has to do with indexing files.

So it's fine now.
The only thing I can think of that could cause it is if the transfer between the computer and the ATV was interrupted, and it just let parts of files sit there in a cache.
