Smart Mailbox Folder Disabled

I have been trying to setup a Smart Mailbox Folder but the option is disabled. Does anyone know how to enable it?

seems to be a bug. make a Smart Mailbox Folder and then make a Smart Mailbox. the folder will appear in the sidebar before the mailbox. report it here http://www.apple.com/feedback/mail.html
