smart mailboxes broken?

I did the index rebuild knowledge article but my smart mailboxes aren't working... even the one just that shows unread mail from my accounts is empty.

This happens if Spotlight is disabled : check Spotlight exclusions in System Preferences / Spotlight.

only exclusion is time machine drive.

Went to safe mode, redid authorities and such. Then wipes the indexes for mail and let it rebuild. I really have no idea why a software update would make such a mess of mail. However there was one other thing I did at near the same time, go iCloud
