I recently downloaded libre office and have been working fine. Recently there was an update, however when i try to delete the old version, its stopped because it says it being used. how is this possible?

Did you quit the program or only closed the window?
 
there has to be an open process in the activity monitor, maybe it has a not easy recognizable name. if you can't find it, restart your machine.
 
Hold command while selecting empty trash to securely empty. In my experience, this works for anything that OS X says is "in use" even if it doesn't appear to be.
