I downloaded the software upgrade, but was unable to to transfer the apps (using apples method), is there any other way of doing this? Besides jailbreaking?

I originaly registered an iPod that I exchanged for the one I am using now (dead pixels), could that have anything to do with it?
 
If you downloaded the apps from iTunes there should be an ".ipa" file in the following directory:

XP: C:\Documents and Settings\<username>\Application Data\Apple Computer\iTunes\Mobile Applications

Mac: username/Library/iTunes/Mobile Applications

I have found that the following works...

Move that .ipa file to another user directory (i.e. another user account's iTunes>Mobile Applications)

Log into that user account

Open iTunes > Sign into iTunes account with the ID you used to purchase apps

Sync the iPod touch

Worked for me :)
