The Gym should have on property security and or insurance against theft of property belonging to 3rd parties. I would ask the gym for a copy of the policy which by law they must give you as you are a user of this facility. You may find that they can make a claim, after all you was paying them a fee to use the gym it should sate that if you are a paid user you are insured while you are inside the building in case of fire or accident. Worth looking into. I had my camera stolen in an Airport Restaurant in Spain and they had a security guy on the door he did not see it and the security cameras did not pick it up. After my lawyer looking into their insurance policy they was liable for personal objects stolen while on "Their" premises but not the airport premises.

Most gyms have signs posted that they are not responsible for lost or stolen items. Unless it was secured in a locker (which it wasn't) the gym is not liable.

Maybe try to talk to the gym manager. If you put your jacket somewhere (not in showers or changing rooms ect) if they have cameras tell him that your iPhone was stolen and ask them to give the police the tape of the person taking it. Or just have the manager cross reference tv video and the guy buying something, or scanning their membership card. ( sorry never gone into a gym so if unaccurate don't attack me.I'm Only 14.) Please reply if it works.

My wife had her work-provided laptop stolen from her car in the parking lot of a gym (fortunately it was a PC). When she contacted the gym, they looked into the security camera but wouldn't give her any information unless nothing happened. In other words, if the theft didn't happen they'd say so, but if there's something on the camera they won't release the details to anyone other than the police (and only if contacted by them).

however, a sweater is not exactly the best anti-theft deterrent. when i play basketball... i leave my iPhone in my car, along with wallet and sunglasses and anything worth some money. i dont even leave iPod lying around. If it's gonna get stolen, someone is gonna have to break into my car.

Probably equally bad place to keep any valuables, especially at a gym. Thieves know people don't like to keep valuables in the lockers, so they target the parking lot instead, especially in the early morning or after work when they're on their way to or coming from work and leave their laptops in the car.

Dr. Cabrera:
AT&T wants you to keep paying for your iPhone services, why they would not want to sell you another iPhone for the same price you paid?
Talk to the managers either at the AT&T store or the :apple: store.
Act like a customer and they will treat you like one.
Make reference to all the things you have bought and paid in the past.
That is what I will try in your position.

yeah i was going to go back into apple and try that approach

It's not like im asking for a free phone, I am willing to pay $300 for the 16GB, it just seems crazy to pay $500 for the phone, considering I've never even heard of Apple selling them for that price.

Um.. that's what they cost when you aren't signing up for a new 2 year agreement...

i agree with d wade... DON'T bring your phone into the gym! Why do you need a phone in the gym? Especially to leave unattended for 30+ minutes at a time? In this economy? People are desperate these days! Anyone seen SNL the REALLY?? skit on Weekend Update? Seriously, if you cannot be away from your phone for an hour you probably have a crackberry-esque problem. Just workout, get back to the car and check your email. I own a company and live on email, but when I am in the gym, I am in the gym and not to be bothered. There is nothing that can't wait an hour.

Nowadays there are no working public phones out there, and for people that live in cities with winter, it's basic security and common sense to carry your personal cellphone with you all the time. Many people use the cellphone as a social toy but others also use them as a communication tool that allows us to work, and be able to obtain help when needed, like in a car accident or to call a tow truck. If you left it at the car, it also can be stolen. if you let it a the locker it also can be stolen. All of us have different preferences on where to use our cellphones.
Many of us have family with kids and babies, and we have to be ready for them 24x7.
Some others may need to have a way to be reached by his patients and customers even when at the gym.

Apple sold them for $600 when the first iPhone came out.
And after some months they started to lower the prices with the carrier rebates.
Anyway you can get other type of phone from AT&T meanwhile and then if they release a new model later this year then pay for the new model.

If the managers don't treat you like a customer, I will try this: get a free phone or really cheap one, and use your number, disable all the iphone features in your contract, then go to the apple store and buy the rebated one like any other customer will, and ask them to transfer your phone number.
