.....I feel like if I just stop paying rent, or tell them I am moving with the intention of not paying rent, they will try and sue me or something...

talk to your roommates and give them a reasonable amount of time to find somebody else.....if you hate them, who knows, maybe they hate you too and will be thrilled to be rid of you :D

hahaha. Well, they will surely miss their maid!

Well here is what I would personally do.

Give them 30 days notice on the 1st of the month or whenever you pay your rent next and utilities. Find a new place ASAP. Move. Even if you give your 30 days notice you don't have to live there during those 30 days. Then your friends will hopefully hate you less.

When I bought my house I asked about getting out of my lease early (about 2 months) and the landlord wouldn't allow it. So I just saved enough money prior and paid my rent till the end of the lease. Never went back to the apartment once I got my stuff out.

If you think the apt complex will take you to court now or when your roommate moves out (for damages), you can file something called a constructive eviction where you basically evict yourself. I had to do it to break a lease where the owner didnt put in a walkway on a newly built rental house and I was stuck walking thru some serious clay/mud. I was ruining my shoes and car and it was hard to keep from tracking all that into his new house.

If you go this route, documentation, documentation, documentation. You will need pictures and letters where you have made the apt aware of the deficits.

But you cant file this without first being in a contract with the landlord which he is not...

Thanks for all the advice everyone, I'm going to seriously consider it and I will let you know what happens. If anyone here knows any lawyers in Georgia, please ask them for advice...

Thanks so much, love the MR community! :)

Yes, you can. You file the constructive eviction and let the courts decide. If they say there is no contract, then later on the apt will not be able to put something on his credit or go after a wage garnishment. It is on court records. If they say there is a verbal agreement that meets the criteria of a binding contract, then he can ask the court to release him....which once again would prevent later damages.
