I'll make this short and sweet-
If my Macbook has CPU whine/buzz, then might the Apple Store I bought it from consider it defective and waive the 10% restocking fee if I were to exchange it and upgrade to a new MBP (and obviously pay the difference). I am within the 14 days and was going to contact them about the whine/buzz anyway before I even thought about springing for the MBP.

I dont believe they will waive the restocking fee as it is an opened product. Always worth asking.
