i vote for steal it back and make them prove its theirs. "O what? you dont have a receipt? or have proof its yours?.........."
 
Another hint for portable devices, or even larger devices at home if you fear being broken into, is a pen with "invisible ink" which only shows up under UV light.

You can write your initials on the back of any device and it won't show up under normal, every day conditions. However, if your device is stolen and you are lucky enough (as you were) to find the culprits, any dispute over ownership can be dispelled through simply checking the device under UV light and checking that the initials you wrote are on there.

It all sounds a bit "out there" but there have been cases where this has led to stolen items being reunited with their rightful owners.
 
if anyone was curious to what happened..
the 2 culprits were caught.
it was my correct serial numbered ipod.
it was broken and cracked.
the thief is buying me a brand new ipod touch.
i am very happy and glad justice has been served.

Unfortunately people are envious of high end products like the iPod touch and iPhone. It makes me angry however, that honest people who work hard for a living so we can afford these devices can actually be made to fear using them in public for fear of theft. Even when I take my 1G iPod touch out on the train to/from work, you can feel some eyes looking at your device and, depending on the time of night you're traveling home, those eyes belong some undesirable characters.

I don't remove my iPod touch from my pocket if I'm traveling home alone in the evenings from work, simply because there are people who would happily challenge you for your device. I use a set of Shure E110 headphones, so I don't have the problem of the white earbuds drawing attention.

I'm considering using this fear of using my iPod touch in public to get my wife to agree to me upgrading to the 2G touch with actual volume controls on the device itself. Oh yes, I will find a way ... :D

I'm the same. Although I have an iPhone I tend to listen to music on my mini or beat up video iPod because I know it makes me less of a target. I use Sennheiser headphones as well. On the bus home about 12ish last night I realised that everyone on the bus with me was using Apple white headphones and I just thought "seriously?"

Bit of a depressing aspect of today's culture.
