Apple did break third-party menubar apps very deliberately. As to why they want to keep third-parties out of the menubar, who knows.. but there's an apple knowledge base article and an apple technote at developer.apple.com, both of which say that third-parties are not allowed in the menubar yet offer absolutely no rationale. The guys at Aladdin spent *a lot* of time trying to get MagicMenu working under 10.2, but apple will break it in an update, sure enough.

Just in case you are too frightened to look, Aladdin Systems claims that Stuffit Deluxe 7 is MacOS X 10.2 compatible and that it includes Magic Menu. Of course, they could be wrong, but somehow I doubt it.
