Screw them

Screw them into the ground. Looks like this is the last of Luxpro's 30 years of 'innovation'.

Innovation and ideas are what makes Apple a great company - sure you have to pay a bit more, but Apple see through to the user better than any other tech company I know of. This means that features on Mac OS/iTunes/iPod often get overlooked by othe manufacturers and other companies can't work out that 'Apple magic' - as has been demonstrated recently with the iPod/iTunes and the fact that there is nothing like iLife on the PC

slightly o/t - but what's the point of technology if you can't do anything useful with it?

I checked with Apple Store folks and they said they sell audio recorders and FM receivers for the iPods but not even 100 to 1. Steve is sure disciplined these days (applause).-

Where have you seen FM receivers for the iPod? I asked at my local Apple Store (Tyson's Corner) and they didn't have anything but the iTrip, which transmits FM signals.

I bought an inline receiver from a mail-order company that has the ear buds built-in, but don't use it much as the ear buds bother me, and without a screen, the FM tuner is hard to use since I can't see what station I'm on, and would rather not have to wait 5-10 minutes to hear their call signs.

To those who say that this sends a message that Apple should be selling it cheaper, did you think about quality, not to mention research and development. This company reverse engineered the shuffle, and there is no guarentee that they are concerned with quality. But of course, they will likely be paying a hefty legal fee, and will have wasted all the money they did spend on reverse engineering and initial advertising.
My thoughts exactly. There's always someone who can sell something cheaper. This doesn't mean it's just as good.

It's easy to offer "more for less" when you don't have to spend money on R&D or hire an advertising firm to design an ad campaign. Apple designed the product and paid for an ad campaign; that's why it costs more for Apple to sell the product than it might cost of LuxPro to sell their ripoff with more features.

Hey, I totally agree with and understand that BUT that is one of the issues. Cost. I'm sure Apple's cost is really high all along the development chain. Unfortunately, they are going to have to deal with this issue for years to come. I'm not fond of the Chinese or Korea's in their business practices. Funny example on a Micro scale is that I use to print and sell Funny T-Shirts at local markets/flea markets and such. What would happen is that some of the Korean vendors would come and buy one of all our Tshirts and don't you know, the following week they would have our exact same design printed or cheaper ass shirts. I wanted to beat the crap out of them and almost did one day but my brother pulled me away. This is a huge issue and very deep rooted. It starts with high development costs in this country and then higher wages, WHICH by the way, given the fact that the labor cost is higher in this country, the average wage STILL isn't up to snuff with the standard of living. Real sad. Which that said, people have to look for bargains, SO they accept this knock offs with open arms. What to do?

well their site is still up and running, it does seem to be having technical difficulties at times but it is still there.

Most likely you will not see it at a Wal-Mart near you, even with Wal-Mart's close ties to China. However, do not be surprise if you trend setting Chinese will not be sporting them real soon. As it been pointed out China has no issue with copying and sharing, remember in the Communist State it all about the common good, no one has rights to anything including outsiders. This product may be banned from US and Europe but that will not happen in China.

will this new shuffle work with itunes, sounds like a good product, maybe apple copied them? no seriously, doesn't the apple shuffle look a lot like this one? Apple even copied the advertising. What happened to innovation apple?

;)

Yeah, this will cover 'em!

Protectable trade dress is infringed when a "likelihood of confusion" exists between defendant's trade dress and plaintiff's trade dress. The similarity between trade dress is gauged by the "ordinary buyer" standard. Would "unthinking" buyers believe both products came from the same source? If the same overall impression leads the ordinary buyer to that conclusion, infringement probably exists.

Among the factors a court will weigh to determine likelihood of confusion are:

The strength or distinctiveness of the trade dress
The intent to copy and "cash in" on plaintiff's reputation and goodwill
The similarity in products
Evidence of actual confusion
Degree of care exercised by buyers
The area, manner and degree of concurrent use.

did anyone else notice the page says copyright 2004? Perhaps they stole the design earlier or worked on it pre-production and then made it?
Hmm.... I wonder if they fake powerbooks too....

I was just checking out their site and it looks like they've changed the name to "Super Tangent" and it comes in colors!
