Tabs not opening in background in Safari?

I know there's a new preference that tells new tabs to open in the background, but when I click a link on a page that causes a new tab to open, it opens in the foreground.

Anyone else have this problem?

Do you just tap or tap and hold to show the menu? Is working for me..
