They changed my iPhone... V. 3.0.1 now

My iPhone died yesterday and I got a new one today at the Apple Service Center. The thing is that ii came with OS 3.0.1. Should I updated it to 3.1 or stay where it is... can I have Internet Tethering again?

3.1 stops tethering as far as I know.

If you want tethering, stay on 3.0.1 with that IPCC hack thing.
