I've installed a new HD in my MacBook, but SuperDuper and Carbon Copy Cloner are both creating permissions problems (anyone know why perhaps?). It looks like I'm going to have to reinstall OS X on the new drive, but I'm wondering - would TM or Migration Assistant give me more of my data? I need everything if possible - media, apps, licenses, preferences, etc.

Does TM back that all up? And if not, can Migration Assistant transfer it all? Which is my best bet?

For your needs, try Time Machine. It would work best and if you have them, why not use them? On the other hand Migration Assistant might be better for settings. It is your call.
