Trash Can Shows Empty, But Its Not

At random times the trash can icon shows its empty, but when I click on it, there are files like recovered files and the files the I put in the trash can. Is this a bug in Mavericks? The only temporary solution for me is to force quit finder.

This is a known bug.

I just open up Trash and then empty it via the Finder window that pops up.

Open up finder & click "secure empty trash".
