I've had this problem multiple times when updating the Apple TV. The solution for me was to connect it to the network via Ethernet instead of Wi-Fi.

I also first got "update unsuccessful", now trying again and getting "The AppleTV update could not be downloaded at this time".

Did Apple realize there's a bug at the last minute and pull the release? Seems like it.

If you can get through Apple's traffic and download it through here, you can update via a micro usb plugged directly into your Mac with iTunes.
