My dad and I are on a family plan (I'm 17) and he is eligible for a upgrade. I won't until December or January. I wanted to ask when (iPhone 5) comes out could I use his upgrade on the new phone? I just want to avoid paying 400 dollars. I have a job so I would give my Dad $199 for 16gb. He said if I can use it he wouldn't mind, as long as I give him cash for the new phone (which I already was planning to do).

I will, my dad using his iPhone 3GS mostly for calling. I still am not sure how I have my upgrade so much slower. I got my iPhone 4 for free, from my uncle who cracked it. He never registered it with Apple/iTunes so I was able to get it fixed for free at Apple. I guess when they gave me a micro-sim at AT&T they counted it as a early upgrade.
 
I have 5 phones on a AT&T family plan and I always use 1 of them to upgrade. You don't have to use your own phone to get a upgrade, You can use another line.

So let's say I was upgrading to a iPhone 4 (already have one) with my dad's line when it comes in the mail from AT&T would I put my SIM in it? What if my SIM was a Mini sim (not micro sim)?
 
you should just go to AT&T store and let them take care of it. they help people do these "upgrade swaps" all the time.
