Upgrade help.

My dad and I are on a family plan (I'm 17) and he is eligible for a upgrade. I won't until December or January. I wanted to ask when (iPhone 5) comes out could I use his upgrade on the new phone? I just want to avoid paying 400 dollars. I have a job so I would give my Dad $199 for 16gb. He said if I can use it he wouldn't mind, as long as I give him cash for the new phone (which I already was planning to do).

I will, my dad using his iPhone 3GS mostly for calling. I still am not sure how I have my upgrade so much slower. I got my iPhone 4 for free, from my uncle who cracked it. He never registered it with Apple/iTunes so I was able to get it fixed for free at Apple. I guess when they gave me a micro-sim at AT&T they counted it as a early upgrade.

They are known to pull nonsense like that in the past.
Locking you into a 2 year agreement just by giving you a simcard and adding you to a family plan or something.

I have 5 phones on a AT&T family plan and I always use 1 of them to upgrade. You don't have to use your own phone to get a upgrade, You can use another line.

So let's say I was upgrading to a iPhone 4 (already have one) with my dad's line when it comes in the mail from AT&T would I put my SIM in it? What if my SIM was a Mini sim (not micro sim)?

All new phones come with their own Sim. You don't need your old one.

you should just go to AT&T store and let them take care of it. they help people do these "upgrade swaps" all the time.

Exactly.
This way you wont have to bother with cutting sims or other stuff.
He will be charged with the upgrade and you will just use the device with your simcard/phone number.
