Could our current MBP be upgraded via a software update or is this a hardware issue?
 
Apple will support USB when Intel puts it in their chipset. Currently Intel doesn't put USB 3.0 in their chipset.
 
it's a hardware issue, or at least till someone makes a thunderbolt to USB3 adaptor... I think thunderbolt is the only port that is fast enough to do this and maintain USB3 speeds.

The expresscard34 2.0 slot in the 17" MBP's is fast enough too. You'll get the full USB 3.0 speed with a proper card.
