VirnetX doesn't product ANYTHING. ZIP. NADA. ZILCH.

However, they're great at litigating against others.

They even claimed that Goldman Sachs, Merrill Lynch, and Charles Schwab tried manipulating their stock price.

Of course, two of the three biggest investors in VirnetX are Vanguard and Morgan Stanley...surprise, surprise.

BlackRock, their largest investor is a significant shareholder in...yep, you guessed it...Apple, Microsoft, and Cisco. The same companies VirnetX loves to sue.

Oh what an incestuous little web we weave.
 
I don’t buy that definition. IMO, the actions taken by owners of patents is what defines them as trolls, not the organization of their company. A company that make products could act like a troll and a company that only owns patents could behave ethically and not be a troll.

If I’m a small independent inventor, and I come up with a new invention, then I’m supposedly a patent troll because I don’t actually manufacture anything? What if I want to license my invention to a large company, because I don’t have the millions (or billions) required to go into production? Suddenly I’m a troll just for creating something but not producing it myself?
You wouldn’t be a troll.

A troll would be the company that buys your patent for a hundred thousand dollars and then starts suing other companies around the world for billions of dollars even though they probably don’t even use the technology in the patent.

VirnetX isn’t just going after Apple, they have sued or threatened to sue almost every large tech company, and made insane profits, even though everyone agrees the patents shouldn’t have ever been granted in the first place.

Also your hypothetical scenario cannot ever happen. It costs tens of millions of dollars to fight someone for patent infringement. No “small independent enventor” has that kind of money. Patent lawsuits are only ever filed by patent trolls or huge corporations.

VirnetX originally had 4 patents related to LTE. They have never used one to sell an actual product. They have over 100 now. Nothing they created, just bought up. 90% of their employees are lawyers.

They define the term "Patent Troll".

You are allowed to create & hold a patent without releasing a product. Have a look how many patents apple holds, yet hasent released 1 product based on them!!

What's your point. The iPhone has absolutely nothing to do with the 1000's of Patents they hold & do absolutely nothing with, which another company could. In fact they are holding patents in areas, where other companies are actually releasing products. Should Apple give them up? Under your system, they should.

In this case, they have been found to have used Patents from another company. Its as simple as that, you can't just take someone else's patent, just because you feel like it & justify it by saying "but judge, we make products".

The purpose of a patent is to protect an active endeavour. If you sell it to a patent holding company, then you really has not taken your idea seriously nor tried to venture it. If you were serious of the idea, then you most likely should have sought companies in the field to pursue a possible collaboration or further advancement of the idea. If the patent was considered to be not of economic value, then there won’t be takers and the idea should go back to general circulation to assist the next great idea, as for academic research. Of course, reality is never that simple and laxity in the laws permit trolls to exist.

At least the court is fair sometimes letting the smaller patent troll (VirnetX) win against the giant patent troll (Apple).
 
I love the cry of patent troll.

This is the system that apple uses. They either comply legally or suffer like they are currently. It is the same for any business. Just becuase you create a product doesnt devalue your invention in any way shape or form. Also doesn matter if you buy the IP. Thats the world. Suck it up and pay your debts.

Whilst that may be right, do two wrongs make a right, I mean someone being a patent troll makes it Ok for you to steal something they own does it?
