iPod touch Warranty question

My 3 year son submerge my iPod touch in water one day and it stop working, I say a few months ago. Well I read to wrap in a bag of rice, so I did, let it sit in the rice for a few weeks. It came back on and was working fine for months. Then one day it got over heated and I think it burned out. It is dead now and doesn't work.

Can I still apply my warranty to it? TIA
