What kind of 3rd party insurance did you have on your phone? What company?
I'm in Europe (Germany)
The insurance broker is https://www.friendsurance.de and the insurance itself is https://www.deutsche-familienversicherung.de

Basically what they told me is that since I did not tell them that there were water damages (I was not aware of any), they will not pay back. Even if the contract clearly and explicitly says that "any damages including water damages are 100% covered".

I called them and emailed them several times but no way to get a proper answer so I called a lawyer who is sueing them. Let's see how they react

If there is anybody from Germany reading this, I discourage you strongly from signing a contract with them for obvious reasons.

Sorry to hear, hope you get them to do what's right and cover the damages.
Insurance's like to collect the money but when it comes time to pay out they will make any excuses to try getting out of their obligations.
 
Wow, that's pretty strange. You have to tell them what is wrong with the phone when you send it in. If you leave anything out then it's not covered??? How on earth do these crooks stay in business? And of course they don't tell you any of this until your try to collect and then it's too late. :(

Yep .. insurances earn money by not paying back. That's their business model.

Hopefully, it won't be a drawn out affair before they are forced to do something.

These places need to be accountable and claimants like you need to follow through to make sure they do...good luck and update this thread accordingly.

Actually that's what happened. The insurance send the phone back and told me that I have to describe how the water damages happened. I naturally declined because I refuse to admit and invent something that I did not do.

I would say I don't know how it happened and you (the insurance company) are the ones claiming there is water damage and if so, it is covered by your policy.

In the US we have government agencies that regulate insurers. If you do too, I would file a formal complaint with them.

My lawyer contacted them and gave them 10 days to pay me back. If they don't, we'll go to court.

In the US it would cost far more to go to court than to buy a new iPhone.

Yes going to court might cost a lot but that's something I will discuss with the lawyer to see if it's worth it.

In the US, a lawyer would bill you about $350 for a phone conversation explaining the problem and then for their time to draft a letter to send to the insurance company. You can buy a used iPhone 6 off of swappa for less than that.

I paid him 100€ for one e-mail that he sends to the insurance.

If you are a legal resident of Germany and you bought an insurance policy from a German company, the German insurance regulators should accept a complaint from you.

That's about $100. It is very quickly going to get more expensive than buying a used phone.

That's why I suggested pursuing this through a government agency that regulates insurance -- that is free. I don't think you need to be a German citizen to make a complaint to such a government agency. It is enough that you are a legal resident doing business with a German insurance company while residing in Germany.
