Masimo is suing CBP.

“Masimo on Wednesday also asked the court for a temporary restraining order and preliminary injunction to block enforcement of CBP’s Aug. 1 ruling. The company wants to restore the January decision, reached after a proceeding in which both Apple and Masimo participated, that allowed imports only if the oxygen-tracking function was disabled.” Bloomberg Law
Of course they want the ruling from January to be restored. I doubt Apple would have released the update without approval from ITC and CBP. Those two entities work together to investigate/enforce patent disputes. Sounds more like Massimo is upset they weren't told Apples work around would be approved lifting the ban..

If it were approved by the ITC, there would be no need for a secret ex parte proceeding between CBP and Apple. The CBP would simply print the updated ITC decision and hand the paper to Masimo.

Apple's own press release reads, "This update was enabled by a recent U.S. Customs ruling." I seriously doubt Apple forgot to credit the ITC.

It's seriously troubling that an enforcement agency can simply reinterpret an ITC ruling without the ITC. The fact that CBP rejected this workaround back in January 2025 and then changed their decision now, when Apple announced their investment and gifted the 24K gold trophy is even more concerning.

It's possible that this administration decided to intervene. Not sure if the president has the authority to do that beyond the 60 days the last administration had to veto the original ITC ruling..We'll just have to wait and see what the courts say.
 
It never left my wrist; however, based on past discussions in this form, many people here doesn't seem to be too interested in the blood oxygen feature.
As a pilot, I think it's very important that my iPhone will alert me if blood O2 gets too low flying at high altitudes in an unpressurized plane.

Really hoping the AW will show O2 levels instead of having to check my iPhone....

I'm not aware that you'd get a notification when SpO2 falls below a certain threshold, but I could be wrong.
I know that you get a notification for high heart rate and Afib ...
